Many people are not aware that a default community of property regime applies if they do not conclude a marriage contract (also known as an “antenuptial contract”) before getting married. There are many reasons why community of property – which is only one of three possible common law options – might not suit a couple’s particular needs. It is therefore best to consult with experts before getting married in order to ensure that one makes an informed decision.
When a person becomes incapable of managing their own affairs, the strongest legal protection their family can offer them is to appoint a curator. This ensures that a person who has court-mandated authority is put in charge of their affairs, ensuring that any decisions they make are recognised in law. It also limits the potential for family disputes between well-meaning family members who might have different opinions on how best to manage their loved-one’s affairs. The process involves a High Court application, supported by psychiatric evidence as well as motivations from the family. We have assisted many families to take this difficult, but crucial step.
